We always handle your information with care and store it securely. If you have any questions or want to know what information we have on you, please contact us. If you do not agree with our policies and practices, we recommend that you do not use our services.We may amend this privacy statement if necessary. We recommend that you regularly review this privacy statement so that you aware of these changes. This privacy statement was last modified on 13 December 2023. 1. When do you apply this privacy statement?

This privacy statement applies to all personal data that we process and to all domains related to us. This concerns the personal data of everyone who has ever had contact with us, used our app or visited our website, such as visitors, customers, and business contacts. Personal data is all data that can be traced back to you as an individual, such as your name, telephone number, IP address, customer number or surfing behavior. 3. Personal data that we process

We may process your personal data because you use our services, hardware or product(s), you create an account with us and/or because you provide these data to us yourself. For example, you may provide us with your contact details if you wish to communicate with us, if you create an account via our website or app or if you place an order (without creating an account), if you wish to receive further information about our services, if you wish to apply for a position within our organisation or if you wish to transact with us.

We then process this personal data to perform our services and/or inform you. Without this personal data, it is not possible for us to provide our services and/or inform you.

Depending on how you use our website or app, we may collect different types of data, including:
- data that identifies you personally, such as name, email address, account number, address details and telephone number;
- data about your internet connection, including the IP address, the marketing that led you to our website and data about the use of the website;
- data about products or web pages you view, the products you add to your shopping cart and purchases you make through our website.

- delivery address and billing address (if different)

- telephone number
- payment details
- account details (username, profile picture (optional) if you choose to create an account with us
- user data (number of exercises and scores and video’s) and static data (total number of exercises and scores), also provided (by you) via our hardware and products.

If you contact our customer service team, we may ask for additional information so that we can respond to your queries as thoroughly and completely as possible.


Data we collect automatically as you navigate our website.

We use automatic data collection technologies, including third-party services, to collect additional data about your devices, browsing actions and patterns, including:
- details about your visits to our website, including page views and clicks, search activity, shopping cart activity, location data and the resources you access and use on the website;
- data about your computer and internet connection, such as browser type, browser version, operating system and IP address. This data allows us to see which parts of our website are most visited and allows us to improve the quality of your online experience by recognising and offering more of the features and services you want. To better understand and optimise the user experience, we also use third-party user session recording technology. The recording does not show us any personal data that the user enters on our website.
- data about your online activities within a certain period of time and on third-party websites or other online services (behavioural tracking).

The automatic collection of this data helps us to maintain and improve our website. It also allows us to check system and server integrity, and to provide you with a more personalised service. 6. What do we use your data for?

We collect and use your personal data to deliver the information, services and services you have requested, to administer the website and to make the app work. We may also use your personal data to inform you of our services through our newsletter. We may also use your personal data to conduct research and analysis in order to improve both our website and our services.

- Performance of a contract. For example, to fulfil an order you have placed on our website, we may need to process your payment details, as well as your contact and shipping details and information about your purchase;
- Legal requirement. Certain laws and/or regulations may require us to collect and retain information for a certain period of time for tax purposes, or to prevent fraud and other illegal activities;
- Permission. For example, when you choose to receive mail marketing, you consent to us processing your email address and/or contact details to send you emails about special offers and sales, product launches. In the case of consent, you have the right to withdraw it at any time.

We may also process your personal data for our legitimate interests. These interests include, but are not limited to:

- understanding how our customers use our products, services and website;
- researching and analysing the products and services our customers want;

7. How long do we keep your data?

We keep your personal data for as long as we are required to do so by law and for as long as necessary for the purpose for which we use your data. For example, as long as you are a customer with us, we store your data according to the statutory retention period of seven years. After that, we only keep your data for statistical purposes and to handle any complaints or legal matters. 8. Who do we share your data with?

We only process your personal data ourselves. We don’t share, sell or trade your personal data to other parties.

However, the personal data you provide may in some cases be processed by third parties. We only share the data necessary for the task performed for us by the external service provider. The personal data you provide may be transferred to the following third parties:
- payment services, collection agencies and credit reference agencies;
- ICT service providers such as hosting providers and website developers;
- advertising and marketing partners;
- logistics companies;
- government.


These third parties are bound by contractual and other legal obligations to treat your personal data confidentially and to respect your privacy. They therefore only have access to the personal data they need to carry out their work. If required, we will enter into a processing agreement with these third parties.

We have done a lot to protect your data as well as possible, both organisationally and technically. We have secured our systems and various means of communication to ensure that your data does not end up in the hands of others. Your data is therefore safe with us. We also ensure that your data is only used by people who have received permission from us. 11. Cookies

We use functional cookies for the technical operation of the website. If consent is given, we also use analytical, advertising and social media cookies. If you do not give permission then ads will still be shown, but they will be random ads. The analytical cookies are used to determine anonymously how our users use the website. The advertising and social media cookies are used for marketing purposes.

A cookie is a small text file that is stored on your computer, tablet or smartphone the first time you visit this website. The cookies we use are necessary for the technical functioning of the website and your ease of use. They ensure that the website works properly and, for example, remember your preferences. They also allow us to optimise our website.

Google Analytics

Our website also places cookies from the US company Google, as part of its "Analytics" service. We use this service to track and get reports on how visitors use the website, measure interest, and improve the services we offer both to our customers and users. Google may provide this information to third parties if Google is legally required to do so, or insofar as these third parties process the data on Google's behalf. We have no influence on this.

Because we use your personal data, you have various rights. We have listed these rights for you below.

Right of information
We must explain to you in an understandable and clear manner what we do with your data and what control you have over it. That is why we explain in detail in this privacy statement what data we collect from you and how we handle your data.

Right to access
You may always ask us to view the data we hold about you.

Right to correction
You may ask us to have your data corrected in it is incorrect or incomplete.

Right to object
You may object to the processing of your data if you do not agree with the way we handle your personal data. This right applies to the data we use for direct marketing. You can indicate to us that you no longer wish to receive e-mails from us. This also applies to personalised recommendations on our website.

Right to data portability
If you are a customer of ours or if you have given permission for the use of your data, you may ask us to send you the digital data we have about you. This way you can transfer that data to another organisation if you wish.

Right to restriction
You may ask to limit the use of your data. This means that in certain cases we may only store your data but not use it.

Right to be forgotten
You may ask us to delete all data we have about you. We will then delete all data that can be traced back to you. In some cases we cannot or may not yet delete your data. For example, we have to keep some data for 7 years for the tax authorities.

Right to submit a complaint
You may submit a complaint about the way in which we handle your data. If you have a complaint, we will be happy to resolve it for you. To do so, please contact us. You may also submit your complaint to the Dutch Data Protection Authority. Of course, we hope that it does not come to that, but if it’s necessary you can also go to court. In that case, the court in the place of business of X-skills is the one which will handle your complaint.

How do I submit a request or complaint?
You can submit your request or complaint to us by sending a mail to info@x-skills.com. We process every request or complaint within 30 days. If you submit multiple applications or complaints or if you submit a complex request or complaint, this may take more time. In that case, we will contact you within 60 days at the latest. We may ask you to identify yourself. In that case, we will ask you to submit certain information to ensure that you are the correct person whose personal data is. We would also like to point out that you also have the option of submitting a complaint to the national regulator, namely the Dutch Data Protection Authority (AP).

13. Social media buttons

Our website may include buttons to share pages on social media platforms such as Facebook, LinkedIn and Instagram. These buttons are pieces of code from the social media itself and use a cookie. This cookie remembers that a visitor is logged in, so that one does not have to log into Facebook, LinkedIn or Instagram again when they want to share something.

14. What rules apply to this privacy statement?

Our privacy statement must meet several conditions. These conditions can be found in particular in the Dutch General Data Protection Regulation. In addition, the general rules that apply under Dutch law apply to our privacy statement.

15. What do we do with data of minors

We do not target minors with our website or as an organisation. This means that if you are under the age of 18, you need permission from a parent or guardian to use our website. If you are a minor when you visit our website or webshop, we assume that you have received this permission before your visit.
